This article seeks to study the extent to which jurisprudence and extraction of jurisprudential issues depend on Arabic grammar (ʿIlm al-Naḥv). You will read instances of the jurisprudential issues that I have chosen to explain their dependence on grammatical rules. They include issues pertaining to doubts regarding the rule (al-shubahāt al-ḥukmiyya) which is the main focus of this article, as well as doubts regarding the object (shubahāt al-mawḍūʿiyya). If there is any kind of digression, it is necessitated by the occasion of the place and the context of speech. The reader will read also two examples of the theoretical (Uṣūlī) rules that have very much to do with the grammatical rules and are not needless of them. The article, therefore, consists of an introduction and three sections: 1.The need for Arabic grammar in the derivation of legal rulings, 2. Grammar and jurisprudence and 3. Grammar and theories of Islamic jurisprudence (ʿIlm al-Uṣūl).
