The problem of reconciling between a command and prohibition is one of the issues of the science of ʿIlm al-uṣūl. Its jurisprudential applications are many in jurisprudence and legal theories. Thus, it is very important to extract information based on the words of the scholars and the issues found in jurisprudential sources. This article undertakes this important function in a scientific and analytical way.
Among the applications of jurisprudence which is well-known to the scholars of ʿllm al-uṣūl is the prayer in the usurped place, but it is important in this article to show other examples, including the act of bowing and prostrating in the usurped place, performing ablution, ghusl and tayammum in the usurped place, and praying in usurped clothing. There are also four other examples to add, including circumambulation in usurped clothing, burial of the dead in a usurped place, prayer that is contrary to taqiyya, prayer required for the desecration of the believer, shrouding in unclean or usurped clothing or silk. Likewise, when someone is praying and he is greeted with a salām and he does not respond to it is another example of the command and prohibition being together. These are issues discussed in an analytical and scientific way in the context of reconciling between command and prohibition (al-jamʿ bayn al-amr wa al-nahy).
